Practice Areas

We provide legal representation for many types of litigation. The best way to find out if we can help is by booking a consultation with us.

Overview

Construction Law

We act for general contractors and subtrades to preserve and perfect claims for lien and prosecute those claims to payment or judgment. We also act for owners and general contractors to defend lien claims that do not have merit, and to assist them to remove those lien claims from the title of the project (referred to as “bonding them off”).

In both instances we use the procedures available to resolve disputes including mediation, settlement conferences, and judicial pretrials. We often employ appropriate experts such as engineers, or those with experience in the building trades. We use our experience and credibility to either reach a favourable settlement at an early stage or build a strong foundation to go to trial or arbitration when appropriate.

Overview

Family Law & Estate Litigation

If you are dealing with a martial breakdown, either at the separation phase or divorce, we can assist. We also handle situations involving child and spousal support, parenting time and decision-making responsibility, and even property division. We understand that this is a stressful time and try to minimize the stress you are going through. We also understand that family law contracts can be complex but necessary. If you need an agreement drafted, such as a cohabitation, marriage or a separation agreement, we can help with that too.

Much like family law, our estate litigators can assist when you are having issues after a loved one passes. This is a complex area of law which requires not just a knowledge of the law, but a compassionate and flexible approach. At Carroll Heyd Chown we take an approach we like to describe as a “firm but fair”. Often these situations can be resolved through tactful negotiations, without the need for expensive, stressful litigation. Of course, if litigation is required, we can assist there too. Let us explain your options to you so you can make informed decisions.

Employment Law

Employment Law

Employment law is a constantly evolving, fluid area of law. Legislation, such as the Employment Standards Act or the Ontario Human Rights Code, is consistently being altered or updated. As well, the Ontario courts, always in tension with the legislature, continue to alter the landscape of employment law with every passing day. Therefore, navigating employment disputes, whether as an employer or an employee, can be tricky.

We act for both employees and employers in a broad range of employment disputes, including wrongful termination cases, notice pay disputes and negotiations, severance package and/or notice pay assessments, employment contract reviews, Human Rights complaints, Occupational Health and Safety Act infractions, and accommodation considerations in cases of disability. On the employer side, we provide a wide array of services, including assessments of employer manuals, contracts, and handbooks; employee accommodation request assessments; assessments of appropriate notice pay and/or severance pay; and termination of employment litigation risk assessments.

Employment disputes can be emotional, complex, and multi-factorial. Our lawyers are well-versed and experienced in providing reasoned, practical advice, no matter the circumstances.

Overview

Commercial Litigation

Employment Law

Few businesses want to be involved in litigation. The stakes involved in a lawsuit can range from “unproductive distraction” to “company-threatening.” We have lawyers with a diverse range of experience to match the needs of your business. Whether it is a shareholder or partnership dispute, a contractual dispute, or a collection matter, you can have confidence in our team. We have a reputation for being prepared. You will have instant credibility with us as your litigation counsel.

When your business must commence a lawsuit to protect its rights, or when you are sued, our goal is to help you achieve the best possible result as quickly as possible, so you can remain productive, or return to productivity as quickly as possible. Occasionally businesses want to set a precedent. Sometimes the “principle” of the matter is important, and it is necessary to take a principled approach to a dispute. Sometimes it’s best to just hold your nose and be practical and get a case settled. We will help you assess the approaches and strategies that will best suit your business’s needs and goals for the dispute in question.
